Bethesda believes it "will prevail" in Fallout lawsuit


Last week Interplay won a victory in its current court fight with Bethesda Softworks over the Fallout game license. Even though the first round went to Interplay, Bethesda still believes it will ultimately win its battle with. Gamasutra reports that Bethesda's PR head Pete Hines stated, "The court has declined to decide the issues at a preliminary hearing, and determined that the parties should maintain the current status quo pending a trial of the case in 2010. We are confident that we will prevail on our claims against Interplay."

In case you need a quick recap, here it is: These folks crash land on an island and . . . whoops, wrong recap. Bethesda bought the Fallout game franchise from Interplay but allowed Interplay to work on a Fallout-themed MMO as well as to continue to sell the older games in the series under certain conditions. This year Bethesda filed suit against Interplay claiming it did not get Bethesda's approval for the packaging of the older games. It also claims Interplay didn't make its required funding and development timelines for the Fallout MMO. Meanwhile Interplay has been releasing concept artwork for that latter game, which it is calling Project V13.
